DramNote Terms of Service

Welcome to DramNote! By accessing or using our mobile application (“app”), our website at https://DramNote.com, or any associated services, you agree to these Terms of Service. Please read them carefully. If you do not agree to any part of these terms, you must stop using DramNote immediately.
User Responsibilities
You agree to use DramNote in a responsible, ethical manner. Specifically, you agree not to:
- Attempt to reverse engineer, modify, duplicate, or redistribute DramNote or any associated materials;
- Interfere with or disrupt our service, network security, or the enjoyment of other users;
- Use DramNote to share offensive, harmful, fraudulent, unlawful, or inappropriate content;
- Collect, scrape, or otherwise harvest user information without explicit consent;
- Violate intellectual property, privacy rights, or other rights of third parties;
- Use DramNote for any form of unsolicited marketing or spam.
Intellectual Property
All content, trademarks, logos, software, and other materials provided through DramNote are owned by DramNote or our licensors and protected by intellectual property laws. You receive only a limited, non-exclusive license to access and use the app and related services for personal, non-commercial use. This license is revocable by DramNote at any time, with or without cause.
User Content and Ownership
You maintain ownership of all content you upload to DramNote, including photos, reviews, comments, and tasting notes. By submitting content, you grant DramNote a perpetual, non-exclusive, transferable, royalty-free, worldwide license to use, display, modify, reproduce, distribute, and create derivative works based on your content, subject to your privacy settings and our Privacy Policy.
DramNote reserves the right to delete or remove any user-generated content at any time, at our sole discretion, without prior notice.
Commercial Use and Advertising
DramNote may feature advertisements, promotions, or offers and may sell products or services directly through the app or our website. By using DramNote, you consent to receive such advertisements and acknowledge that we may use your content (excluding personally identifiable information unless specifically permitted by you) in connection with these commercial activities.
Automatic Updates
To enhance security and functionality, DramNote may automatically install updates on your device. You agree to receive these automatic updates, which can be disabled by adjusting your device settings.
Limitation of Liability
DramNote is provided on an “as-is” and “as-available” basis. DramNote disclaims all warranties, express or implied, regarding the app’s accuracy, reliability, or fitness for a particular purpose. DramNote is not responsible for any indirect, incidental, consequential, or punitive damages arising from your use or inability to use the app or its content.
User-Generated Content and Moderation
DramNote allows users to post content, such as tasting notes, reviews, and images. To ensure a safe and respectful community, we enforce the following policies:
- Prohibited Content:
Users may not post content that includes:- Hate speech, harassment, or threats
- Explicit, violent, or sexually inappropriate material
- Fraudulent, misleading, or deceptive content
- Copyrighted material without authorization
- Any other content deemed harmful or inappropriate by DramNote
- Content Filtering:
DramNote employs automated and manual review processes to filter and remove objectionable content. Our moderation team reserves the right to edit, restrict, or remove any content that violates these policies. - User Reporting System:
Users can report objectionable content through the built-in “Report” button available on posts and profiles. Upon receiving a report, our moderation team will review and take action within 24 hours. - Blocking Users:
Users can block and restrict interactions from other users. This feature is available in the app settings, ensuring a safe environment for everyone. - Developer Action on Reports:
If a user is found violating these guidelines, DramNote may:- Remove the reported content
- Issue a warning to the user
- Suspend or permanently ban the user from the platform
By using DramNote, you acknowledge that content moderation decisions are at our sole discretion.
Links to External Sites
DramNote may include links to third-party websites or resources. We are not responsible for, nor do we endorse, the content, accuracy, or policies of any external sites. You access such external sites at your own risk.
Google Play Store Terms
If you access DramNote via the Google Play Store, you acknowledge that these platforms have their own terms and conditions, which you must comply with. DramNote is solely responsible for the app, not Google, and Google has no obligation to provide maintenance or support for DramNote.
Apple App Store Terms
If you access DramNote via the Apple App Store, you acknowledge that these platforms have their own terms and conditions, which you must comply with. DramNote is solely responsible for the app, not Apple, and Apple has no obligation to provide maintenance or support for DramNote.
Account Termination
We reserve the right to suspend, restrict, or terminate your DramNote account and access to our services at any time and for any reason, including but not limited to violations of these Terms of Service.
Severability
If any part of these Terms is deemed invalid or unenforceable, the remaining provisions remain in effect and enforceable.
Governing Law and Jurisdiction
These Terms of Service shall be governed by the laws of the State of New York. Any disputes arising under these terms will be subject exclusively to the jurisdiction of courts located within New York.
